In Louisiana, you can get a divorce based solely on time spent living apart. You do not have to show, prove or even allege fault of either party to obtain a divorce. Once you have lived apart 180 days or 365 days if there are minor children of the marriage, you are entitled to request a divorce, which is known as a “no-fault” divorce. The other party does not have to give their permission for this to happen. If you have lived apart for the requisite amount of time, then you have legal cause to request that the divorce be granted.
Please note: If there are minor children and there has been a finding by the court of physical or sexual abuse against spouse or child of one of spouses OR a protective order has been issued against the other spouse to protect spouse seeking divorce or a child than the 180-day time period applies. If you want to allege fault or have entered into a covenant marriage, there are different procedures in place.
I have heard that there has been talk in Louisiana of eliminating the 365-day requirement and making the waiting period 180 days for all parties. I will keep you posted if time requirement is amended.
