Many attorneys would tell you that there aren’t really any advantages to who files for divorce first; however, I think there are some advantages that should be considered:
- You have time to emotionally, mentally and financially prepare yourself for the fallout, with less surprises.
- You have an opportunity to start protecting community assets and documenting accounts.
- You can take your time in interviewing and selecting your lawyer and don’t have to rush to find someone to defend you.
- You can initially be in charge of the timeframes and prevent apathy or stalling by the other party.
- You get the first opportunity to choose which jurisdiction will hear your case.
Hopefully, once the process is started, you and your spouse can amicably agree to solutions for some of your issues. If you think that there will be conflict regarding custody, support, use of the home or division or community, then the sooner you begin working with a lawyer the better prepared you will be navigating through your divorce.
